Am I Injured?
You are entitled to workers compensation for all different types of work injury. The following examples are all injuries which are caused by work and can be claimed for:
- Aggravation of an old injury. If you hurt your back a few years ago and now you have pain in the same place or nearby then you can receive workers compensation.
- Gradual onset of injury. If you begin feeling discomfort in your shoulder and the pain becomes worse over a couple of months then you can receive workers compensation.
- Exacerbate an injury. If you injure your ankle at work and then injure it again away from work you can receive workers compensation.
- Bullying. If you are bullied or treated unfairly by a co-worker, boss or customer you can receive workers compensation.
- Assault. If you are assaulted at work you can receive workers compensation.

What Workers Compensation Can I Claim?
If you are injured at work you are entitled to be paid workers compensation benefits for:
- Wage loss. Lost income as a result of your inability to work.
- Medical expenses. Reasonably necessary treatment expenses such as medication, surgery, specialist consultations or physiotherapy.
- Travel expenses. Reasonably necessary travel expenses associated with your medical treatment.
- Domestic assistance. The cost of providing you help at home while you’re injured such as cooking, cleaning and gardening.
- Permanent impairment. A lump sum payment to compensate you for a permanent injury.

Am I Entitled to Claim?
Answer the following questions to determine whether you qualify for workers compensation from WorkCover:
- Are you an employee or sub-contractor?
- Were you injured at work or because of work?
- Have you suffered any loss as a result of your injury?
If you answered Yes to all 3 question you’re likely to be entitled to compensation.
If you answered Yes to 2 questions you may be entitled to compensation.

When you make a workers compensation claim your employer’s insurer must determine your claim by either accepting liability and paying you compensation or disputing liability and issuing you a notice providing the reasons why they dispute liability.
What does section 74 of the Workplace Injury Management and Workers Compensation Act 1998 mean?
If the insurer does not pay you compensation it means they dispute liability for your claim. A section 74 notice is used to notify you of the reasons why the insurer does not accept liability for your claim. It is important to seek legal advice when you receive a section 74 notice from the insurer.
